I Didn’t Realize Bathroom Stalls Were So Important in Tennessee

Mark Lambert is definitely giving Mike Tyson a run for his money.

The brouhaha reportedly began when Herbers entered the restaurant’s bathroom and found all urinals and stalls in use. He says he asked two men who were in the same stall — but not using the toilet — to leave, WCM-TV reported. He claims they refused his request. Lambert, who was using a urinal and carrying on a conversation with the duo barricaded in the stall, began hurling profanity at him, Herbers says, and then shoved him and delivered the bite.

Wow. Greg Herbers, the guy who got bitten is suing for $5MM.  Call it a hunch but something tells me that this dude Mark Lambert isn’t the kind of guy that would have that kind of cash lying around.

I mean maybe if he bit an ear I might give him the benefit of the doubt, but dudes that barge in on people in bathroom stalls biting off noses just don’t seem like the millionaire type.

A police report said that the entire left nostril was ripped off.  I can’t even imagine the pain.  Man.

    Lawyers in cases like this always sue for millions of dollars, even if you think your case is really only worth $5000. First of all, you don’t want to let the other side know how much you think the case is really worth – they might be worried about losing a much higher amount, and be willing to settle for a higher amount, and you don’t want to dispel their fear. Second, you never know if a jury would give you much more than you think – you can’t win more than you ask for, so you might as well just ask for a ridiculous amount and have the jury give you as much as they will. All lawyers know to basically disregard the amount that someone claims they are suing for – whether it’s $1 million or $5 million or $10 million doesn’t matter. Only journalists who know nothing about the way law really works play up cases like “man sues for $63 million for coffee burns”, when in reality the guy will get a few thousand bucks if his case isn’t dismissed outright.
